By visiting or purchasing products from Cakes by Yen or our website, you confirm that you have read, understood, and agree to be bound by these policies and procedures, as well as any additional policies referenced within estimates, invoices, contracts, or hyperlinks.

Cakes by Yen reserves the right to update, modify, or replace any part of our policies and procedures without prior notice. It is your responsibility to review these policies periodically for any updates. Continued use of or access to Cakes by Yen’s website after any changes have been posted signifies your acceptance of those changes.

These terms constitute our conditions of sale. If you need clarification on any matter, please contact us at hello@cakesbyyen.com. Please note that nothing in these terms affects your statutory rights as a consumer.

Orders

We strive to accommodate every order, but we maintain a strict limit on the number of cakes we produce each week to ensure the highest quality. Typically, 3 months' notice is required for wedding cakes and 3 weeks for celebration cakes. For urgent requests, please reach out to discuss availability. Custom designs and special requests may require additional time for consultation and creation.

While we take every measure to ensure order accuracy, it is also the customer’s responsibility to verify that the details on the order form are correct. Although we will do our best to rectify any errors, such as incorrect dates, the final responsibility for checking and confirming order details rests with the customer.

Payments

Celebration/Event Cakes:

A 50% non-refundable deposit is required to confirm your order. This deposit is non-transferable and secures your event date. Orders are only confirmed upon receipt of this deposit, and availability is not guaranteed until payment is received. The remaining balance is due 14 days before the event date.

Orders placed within 14 days of the event require full payment upfront. If the final payment is not received within 7 days of the scheduled pickup/delivery date, the order may be canceled.

Wedding Cakes:

For orders over $500, a $200 deposit is required. For orders over $800, a $300 deposit is required to secure the date.

The remaining balance is due 28 days before the wedding date. Final invoices are sent out 4 weeks before the event, with payment required 28 days prior.

Failure to make the final payment by the due date may result in the cancellation of the order.

Any changes to the order must be made at least one month before the event date. Once the order enters the production phase, revisions are not permitted unless under special circumstances, which may incur additional costs.

General Terms:

Please note that all deposits are non-refundable, and we will not hold your date without the required deposit.

Rental

Cake stand rental starts at $25.00, with a separate damage/loss deposit of $200.00, which will be refunded upon return. Cake stands must be returned within 4 days following the event.

A late fee of $20 per day will be charged for each day the items are overdue. If any rented items are not returned or are returned damaged, the deposit will not be refunded.

Delivery

Free delivery is available for orders within 20 minutes of our location. For locations beyond this range, a delivery fee based on mileage applies, with a minimum charge of $50.

The company is responsible for the cake while in transit. If any damage occurs during delivery, we will make every effort to address it. If repair is not possible, a full refund will be provided.

After delivery, the customer assumes full responsibility for the condition of the order. Instructions on handling and care will be provided.

For wedding cakes with more than two tiers, delivery is mandatory. We do not recommend pickups for multi-tiered cakes.

Pick Up

If you choose to pick up your order, it is your responsibility to handle the cake with care. Cakes by Yen is not liable for any damage that occurs after pickup.

Ensure the cake is transported on a flat surface to maintain stability and minimize movement.

If you appoint a representative to pick up, accept, or set up the order, the customer assumes full responsibility for the condition of the cake once it leaves our possession.

Cakes by Yen is not responsible for any damage that occurs during transport after the cake leaves our location.

It is the customer’s responsibility to ensure the cake remains intact by taking necessary precautions, such as maintaining a cool environment and protecting the cake from elements.

For cakes with more than two tiers, we strongly recommend opting for delivery rather than pickup.

Order Changes

Changes to your order must be made no later than 28 days before the wedding date or 14 days before the event date. We will do our best to accommodate your request, but changes may not be possible with insufficient notice. All order details must be confirmed 2 weeks before delivery. Any alterations may incur an additional charge and must be confirmed in writing.

Order Cancellations

To cancel your order, please notify us as soon as possible and email a cancellation letter explaining the reason. All cancellations must be confirmed in writing.

The deposit is non-refundable. However, the remaining balance will be refunded if the cancellation occurs at least 28 days before the wedding date or 14 days before the event date. Work already undertaken according to the order will be chargeable. Orders with sugar flowers or other decorations begin preparation up to 2 weeks before the event.

Full refunds are not provided. We can, however, postpone your cake to an alternate date if one is available.

Refund and Complaint Policy

Due to the custom nature of our products, all sales are final. If there is an issue with your order, please contact us immediately upon receipt, and we will work with you to resolve it.

Refunds are not provided for dissatisfaction based on personal preference, as taste is subjective. If you are unhappy with the cake, we will make every effort to address the issue before the event.

Cakes by Yen does not offer cash or credit refunds for any cake or dessert order. All sales are final.

Color-Matching Policy

We strive to match your chosen colors as closely as possible. However, achieving a perfect color match can be challenging when working with food colors. For example, food colors behave differently when integrated into various mediums, and dark-colored icing may darken further over time due to humidity or heat. Additionally, colors displayed on computer screens or printed materials may vary due to differences in monitor calibrations and printer settings, and may not perfectly match the final product or the client's vision.

Cottage Food Law

Cakes by Yen operates under the Virginia Cottage Food Law. This law requires consumers to be aware of the following statement:

This product was produced in a home kitchen that is not subject to state licensure or inspection, and that may also process common food allergens such as tree nuts, peanuts, eggs, soy, wheat, milk, fish, and crustacean shellfish. This product is not intended for resale.

Allergy and Dietary Disclaimer

Cakes by Yen is not a nut-free or gluten-free kitchen. While we take great care to avoid cross-contamination, we cannot guarantee that our products are free from allergens. It is the client's responsibility to inform us of any allergies or dietary requirements when placing an order, and we will do our best to accommodate these needs.

Cakes by Yen is not responsible for allergic reactions, medical reactions, or illnesses resulting from consuming our products. Most of our products are not suitable for vegans, vegetarians, or those with religious dietary restrictions unless specifically labeled as such, as they may contain animal products. Customers are responsible for informing their guests about the presence of potential allergens or ingredients that may be unsuitable for their dietary restrictions.

Please note that some products may include nuts and/or other allergens. While we offer gluten-free and nut-free options, we are not a gluten-free or nut-free bakery. If you have any specific allergies, please notify us in advance so we can take extra precautions to ensure your order has not come into contact with these allergens.

Best by Dates

Although we strive to ensure your cake is as fresh as possible, all cakes are best consumed within 2 days of the event or delivery date. This accounts for preparation time, which for larger cakes may begin 2-3 days before the event.

To extend the cake’s shelf life, store it in a sealed container in the fridge. You may also freeze any remaining cake by wrapping it several times in plastic wrap before placing it in an airtight container, for up to one month.

Non-Edible Decorations, Structural Supports, and Fresh Flowers

The customer will be informed of any non-edible decorations and structural supports that will be used to construct the cake. It is the customer's responsibility to communicate this information to the venue hosts.

If fresh flowers are to be used, it is important to note that they may not be food-safe. Fresh flowers are not food products and may contain pesticides, herbicide residues, dirt, insects, or other contaminants. All floral pieces inserted directly into the cake will be cleaned and wrapped accordingly. If you acquire fresh flowers from a florist shop, it is your responsibility to ensure they are safe for use on the cake.

Design Copyright

The design of the cake remains the property of Cakes by Yen. The customer does not hold any claim to the design. We reserve the right to use images of any design for promotional purposes after the event.

Photography and Marketing

Cakes by Yen reserves the right to photograph all cakes and baked goods for marketing and promotional purposes. These photos may be used on our website, social media, and other promotional materials.

If you prefer that your cake not be photographed, please inform us in advance. We may also request photos from the customer or the event photographer for the same purpose, and we will credit the photographer if they agree.

Liability Statement

Cakes by Yen is not liable for any damage or injury that occurs after the order has been delivered or picked up. We are not responsible for any issues resulting from improper storage or handling of the cake.

Agreement
